General Terms and Conditions (GTC)
This English version is provided for your convenience. In case of any discrepancy, the German version shall prevail.

1. Scope
These General Terms and Conditions (GTC) apply to all orders placed by consumers or businesses via the websites
www.hollyshirt.at, www.hollyshirt.net and www.textilprofi.at.
They apply to deliveries to Austria, Germany, the European Union and Switzerland.
By submitting an order, the customer accepts these GTC.

3. Conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer.
By submitting the order, the customer makes a binding offer.
The contract is concluded as soon as we expressly confirm the order or ship the goods.
An automatic confirmation of receipt does not constitute acceptance.
HollyShirt GmbH may refuse orders, in particular in the case of outstanding claims, incorrect information or suspected misuse.
4. Prices & payment methods
All prices are in euros including VAT (except for deliveries to non-EU countries).
The following payment methods are available:
- Credit card
- PayPal
- Sofort/Klarna
- Apple Pay / Google Pay
- Prepayment
- Invoice (by arrangement)
Deliveries to Switzerland
The customer bears import tax, customs duties and the carrier’s customs clearance fees.
These costs are not refunded.
5. Delivery & shipping
We deliver to Austria, Germany, the EU and Switzerland.
Typical delivery times:
- 2–6 working days for non-personalised goods
- 4–14 working days for personalised goods
Express orders are possible. HollyShirt GmbH determines the shipping method and type of packaging.
6. Personalised products
Personalised goods (e.g. T-shirts or hoodies with an individual motif, text or logo) are manufactured to customer specifications.
There is no right of withdrawal for personalised products
pursuant to § 18 (1) no. 3 FAGG and EU Directive 2011/83/EU.
The customer is obliged to check texts, colours and motifs before submitting the order.
The customer alone is liable for any infringement of rights caused by uploaded motifs.
7. Right of withdrawal for non-personalised products
A 14-day right of withdrawal applies to non-personalised items.

The customer bears the cost of return shipping. The goods must be returned unused, undamaged and with their labels attached.
There is no right of withdrawal for:
- personalised items
- unsealed hygiene products
- custom-made products / express productions
- goods that cannot be returned for health protection reasons
8. Retention of title
The goods remain the property of HollyShirt GmbH until payment has been made in full.
9. Warranty
The statutory warranty provisions apply.
No warranty applies to:
- normal wear and tear
- damage caused by improper use
- deviations in colour and size within customary tolerances
10. Liability
We are only liable for damage caused by intent or gross negligence, except in the case of personal injury.
The customer alone is liable for the content of customer motifs (logos, texts, images).
11. Data protection
The privacy policy at www.hollyshirt.net/datenschutz forms part of these GTC.
12. Choice of law & place of jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
For consumers within the EU, the mandatory consumer protection provisions of their country of residence apply.
Place of jurisdiction for businesses: Vienna.
Switzerland
Mandatory provisions of Swiss consumer protection law remain unaffected.
13. Severability clause
Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
14. Information on the right of withdrawal
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason (except for personalised products).
The withdrawal period is fourteen days from the day on which you or a third party named by you received the goods.
Consequences of withdrawal
We will refund all payments within 14 days of receiving the returned goods.
We will use the same means of payment as for the original payment for the refund.
We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods.

The goods must be returned without undue delay, and at the latest within 14 days, to the following address:

Compensation for loss in value
You only have to pay for any loss in value of the goods if this loss is due to handling of the goods that was not necessary.
